VICARIOUS VIOLENCE WITHIN THE CONTEXT OF GENDER-BASED VIOLENCE

Abstract

The Declaration on the Elimination of Violence against Women. approved on December 20, 1993 by the UN UNGA, it recognizes "that 'violence against women' constitutes a manifestation of historically unequal power relations between men and women, which have led to the domination of women and discrimination against them by men and prevented the full advancement of women, and that violence against women is one of the main social mechanisms by which women are forced into a situation of subordination in relation to men".

In this research we will understand "gender violence" as a form of "violence against women" committed by men because they are women (therefore considered by them inferior to men). Since recently, "vicarious violence" - less studied than other forms of gender violence - has also been considered a subtype of gender violence, when directed. against third parties, in most cases Sometimes against the children of a woman that a man wants to make suffer and harm, although also, according to some experts, against other loved ones or against their pets.

We dedicate this work to analyzing the legal and political implications of "vicarious violence" in Latin America - in order to highlight Brazil's legislative and judicial deficiencies in this matter, using qualitative methodology, with case studies, for this purpose.
